General Terms of Use (GTU)

TMA (hereinafter referred to indifferently as “TMA” or the “Company”), whose trade name is THOMAS MARKO & ASSOCIÉS, a simplified joint stock company with capital of €1,000, registered with the Nanterre Trade and Companies Register under number 841 367 097, whose registered office is at Boulogne-Billancourt (92100), 37-41, rue Fernand Pelloutier, is the owner and publisher of the www.thomasmarko-associes.com website (hereinafter referred to as the “Site”).

1. Purpose of the General Terms of Use

The purpose of these Terms of Use (or TOU) is to define and govern the terms, conditions and limits of use and access to the Site by any user.

Users are advised to consult the current GTU, which specify their rights and obligations, before accessing and browsing the site. By using this site, the user acknowledges that he/she has read these GTU, accepts them in full and agrees to abide by them. If the user does not agree with these GCU, he/she is advised not to use the Site.

These GCU complete the TMA Legal Notice (including the Legal Obligations to represent interests), the TMA Privacy Policy and its Cookie Policy.

2. Information and services

The main purpose of the Site is to present TMA (created in 2018) and its brand THOMAS MARKO & ASSOCIÉS (older), its fields of activity and services, its references, its news.

In particular, the Site allows the user to :

  • Discover the expertise and services offered by TMA and its network in France and abroad;

To access these services, the user must follow the instructions indicated on the Site.

3. Accessibility and availability of the Site

The user is responsible for taking all necessary measures to access the Site. Access to the Site is granted free of charge. The user may access the Site without registration.

TMA undertakes to use its best efforts and to take all necessary precautions to ensure the availability of services and the proper functioning of the Site. The user is however informed that maintenance operations on the Site may temporarily hinder access to the Site. Events beyond TMA’s control, such as computer attacks, may also occur. TMA may not be held liable in the event of temporary unavailability of the Site.

By browsing the pages of the site, the Internet user acknowledges having read and accepted the limits of responsibility and the conditions of use of the Site. 4. Intellectual property and protection

TMA holds, reserves and retains all property rights, in particular intellectual property rights, including reproduction rights on this Site and the elements it contains. Consequently, any partial or total reproduction of this Site and the elements it contains is strictly forbidden without prior written authorization from TMA.

The trademark THOMAS MARKO & ASSOCIÉS, the base line “Embrace your cause”, the logos and all other distinctive signs contained on this Site are the exclusive property of TMA or are subject to an authorization of use. No right or license may be assigned to any of these elements without the prior written authorization of TMA or the third party holding the rights.

The content of the Site is the property of TMA and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

5. Exclusion of warranty and liability

The Company shall not be held liable for any direct or indirect damage that may result from access to or use of the Site and/or this information, including inaccessibility, loss of data, deterioration, destruction or viruses that may affect the user’s computer equipment and/or the presence of viruses on its Site.

Although the Company endeavors to provide reliable content on its Site, it does not guarantee that its content is free from inaccuracies or omissions, and cannot be held liable for errors or omissions, or for the unavailability of information and services.

6. Privacy policy – Protection of personal data

TMA has appointed a Data Protection Officer (DPO) to protect the privacy and personal data of Site users in compliance with current regulations.

The role of the DPO is defined by the General Data Protection Regulation (RGPD), which came into force on May 25, 2018 and supplements the provisions of the amended “data protection” law of January 6, 1978 and its implementing decree of October 20, 2005.

TMA, when acting in its capacity as data controller, informs the user that it is implementing computerized processing of personal data concerning him/her.

In accordance with Articles 12 et seq. of the RGPD, the user has a right to information, access, modification, rectification, deletion (“right to be forgotten”) and a right to portability of personal data concerning him or her. The user also has the right to limit processing and the right to object to the processing of his or her personal data for legitimate reasons, as well as the right to object to such data being used for commercial prospecting or profiling purposes.

Personal data collected on this Site is kept for the time strictly necessary to achieve the purposes of the processing concerned, and at most until the expiry of the statutory limitation periods.

9. Status and modification of the GTCU

These GTU were last updated on 15/10/2024.

TMA reserves the right to modify these Terms and Conditions at any time and without notice in order to adapt them to changes in the Site and applicable regulations.

10. Applicable law

These GCU are governed by French law. They are written in French. Should they be translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.
