Legal obligations as an interest representative
TMA acts as a “representative of interests” in its institutional relations, public affairs and influential communications activities.
Act no. 2016-1691 of December 9, 2016 on transparency, the fight against corruption and the modernization of economic life (the so-called “Sapin II” Act) entrusts the Haute Autorité pour la Transparence de la Vie Publique (HATVP) with the management of a digital directory designed to “ensure that citizens are informed about relations between interest representatives and public authorities” (article 18-1 of Act no. 2013-907 of October 11, 2013 on the transparency of public life).
Interest representatives are required to register in the digital directory managed by the HATVP. The Sapin II Act lays down declaratory and ethical obligations common to all interest representatives. In particular, interest representatives are required to file an annual declaration of activities with the HATVP. Decree no. 2017-867 of May 9, 2017 on the digital directory of interest representatives provides a legal framework for the activity of interest representatives.
TMA is registered in the directory of interest representatives. It is subject to declaratory obligations and must comply with the professional rules applicable to interest representatives defined by the aforementioned texts.
